The agreement between you and Brandwhiz.ai when you use the platform.
Company information
Brandwhiz.ai is a product of Sociowhiz (https://sociowhiz.com). These terms are an agreement between you and Sociowhiz, the legal operator of Brandwhiz.ai. Any reference to 'Brandwhiz.ai', 'we', 'us' or 'our' means Sociowhiz.
Using the service
By creating an account you agree to use Brandwhiz.ai lawfully and in line with the terms of the social networks you connect. You are responsible for the content you approve and publish through the platform. You must be at least 18 years old and have authority to act on behalf of the business or brand you represent.
Your content and brand assets
You keep ownership of your brand assets and of the content you create with the platform. You grant us the limited licence needed to store, process and publish that content on your instruction. You represent that you have the right to use any images, logos, text, trademarks and other materials you upload.
AI generated output
Generated strategy, images, captions, hashtags, publishing schedules and other content are produced by artificial intelligence as drafts. Nothing publishes without approval inside your workspace, and you remain responsible for reviewing output for accuracy, suitability, legality, brand safety and compliance before it goes live. We do not guarantee that AI-generated output is error-free, original, non-infringing, compliant with any platform policy, or appropriate for any particular audience or jurisdiction. You acknowledge that AI-generated content may require human review and editing before publication, and you assume full responsibility for any published content.
User responsibility and content moderation
You are solely responsible for ensuring that any content created, approved or published through Brandwhiz.ai complies with applicable laws, the terms and community guidelines of every social network you connect, advertising disclosure requirements, intellectual-property rights, privacy rights, and any industry-specific rules that apply to your business. We provide tools to assist you; we do not control, endorse or verify your content.
Subscriptions and billing
Plans are billed monthly or annually in advance. You can cancel at any time and your plan will remain active until the end of the current billing period. Usage allowances reset each cycle. Fees are non-refundable except where required by law.
Availability
We work to keep the platform available and reliable, but we do not guarantee uninterrupted service. Scheduled maintenance is announced in advance wherever possible.
Indemnification and limitation of liability
You agree to indemnify and hold harmless Sociowhiz, its affiliates, officers, directors, employees and agents from any claims, damages, losses or expenses arising out of your use of the service, your content, your breach of these terms, or your violation of any third-party rights or platform policies. To the maximum extent permitted by law, Sociowhiz's total liability for any claim arising from or relating to the service shall not exceed the amount you paid us in the twelve months preceding the claim.
